The Public Prosecution Service (PPS) at the Department of Criminal Investigation and Prosecution (Departamento de Investigation e Acção Penal - DIAP) of Faro, Loulé section, has discontinued the Inquiry on the death of a trespasser occurred when he entered a villa in Vilamoura, Loulé area, without permission on 20 September 2015.

Based on the elements collected during the criminal investigation the PPS was led to the conclusion that the trespasser’s death by asphyxiation occurred as a result of an act of self-defence of two British nationals - father and son - who lived in the concerned villa. It was further considered that the death was not the consequence of the use of disproportionate means, but rather of an action in the heat of the moment caused by non-reprehensible disturbance or fear.

The collected proof shows that the trespasser entered the concerned villa with the intent to steal, while the householders (i.e. a couple and their son) were asleep. Due to the noise he caused, the trespasser was caught in the very act first by the woman, and then by her husband and son, who heard her shouting. The trespasser attacked them and did not stop his doings even after being grabbed by both father and son, who succeeded in immobilizing him by the neck until the National Republican Guard (Guarda Nacional Republicana) officers arrived to the site after being called thereupon.

The investigation was conducted by the Criminal Investigation Police (Polícia Judiciária) officers from the Sourthern Criminal Investigation Department.

Considering that the party assisting the Public Prosecutor («assistente») has requested the opening of the Examination stage («instrução»), the file shall be submitted to the Examining Judge of Loulé in due time.
